These Terms of Service (“Terms”) govern your access to and use of the APEX Finance website and in-app services (the “Services”). By accessing or using the Services, you agree to these Terms.

- Violating any applicable law, regulation, or sanctions requirement.

- Disrupting, interfering with, or degrading the Services or other users’ access.
- Using the Services to transmit malware, exploit vulnerabilities, or perform abusive automation.
- Fraudulent, deceptive, or harmful conduct, including misrepresentation and phishing.
5. Staking, Rewards, and Risk
Digital assets involve risk, including market volatility, protocol risk, third-party risk, and potential loss of funds. You acknowledge you are solely responsible for evaluating risks, and you use the Services at your own discretion.
6. Intellectual Property
The Services, including software, interfaces, designs, logos, and content, are owned by APEX Finance or its licensors and are protected by applicable intellectual property laws. You receive a limited, non-exclusive, non-transferable license to use the Services for personal, lawful purposes.
7. Third-Party Services
The Services may integrate with third-party wallets, providers, and networks. We do not control third-party services and are not responsible for their availability, security, or actions.
8. Disclaimers
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, APEX FINANCE WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL. TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICES WILL NOT EXCEED USD $100.
10. Termination
We may suspend or terminate access to the Services at any time for any reason, including suspected violations of these Terms, security concerns, or legal requirements. You may stop using the Services at any time.
11. Governing Law
These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of laws principles, except where prohibited by applicable consumer protection laws.
12. Dispute Resolution
You agree to attempt to resolve disputes informally by contacting us first. If a dispute cannot be resolved, it will be resolved through binding arbitration on an individual basis, except where prohibited by law.
You and APEX Finance waive any right to participate in class actions or class-wide arbitration to the extent permitted by law.
13. Changes to These Terms
We may update these Terms from time to time. Continued use of the Services after changes become effective constitutes acceptance of the updated Terms.
